Mbegu Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the Mbegu website, mobile web app, and related services (the “Service”). By accessing or using the Service, you agree to these Terms.

If you do not agree, do not use the Service.

1) Who we are

Mbegu (“Mbegu”, “we”, “us”) provides crop scanning, informational results, and supplier discovery tools.

2) Eligibility

You must be able to form a legally binding contract to use Mbegu.

If you are using Mbegu on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3) Your account and guest access

Mbegu may allow you to use the Service in guest mode or by creating an account.

You are responsible for:

• Keeping your account secure
• Maintaining accurate information
• All activity that occurs under your account

We may suspend or terminate access if we believe your use violates these Terms or risks harm to the Service or other users.

4) What Mbegu does (and does not do)

Mbegu provides:

• Image-based crop scans and informational outputs
• Suggested actions and general guidance
• Supplier discovery information based on your selected location
• Certificates and shareable links when you generate or export a certificate

Important: Mbegu does not provide professional agronomy, veterinary, medical, legal, or financial advice. Outputs may be incomplete, inaccurate, or not suitable for your specific farm conditions. You are responsible for verifying recommendations and making your own decisions.

5) User content (images and inputs)

You retain ownership of content you upload (for example crop images), subject to the license below.

By uploading content, you grant Mbegu a limited, worldwide, non-exclusive license to:

• Process the content to provide the Service (including generating scan results)
• Store the content as part of your scan history (if you use history features)
• Improve the Service (for example debugging and quality improvement), where permitted and consistent with our Privacy Policy

You represent that you have the right to upload the content and that it does not violate law or third-party rights.

6) Acceptable use

You agree not to:

• Use Mbegu to break the law or violate others’ rights
• Reverse engineer or attempt to extract source code from the Service
• Attempt to bypass usage limits, credits, payment gates, or security controls
• Upload malicious content, viruses, or content intended to disrupt the Service
• Abuse the Service (including high-volume automated requests) in a way that harms performance or other users

We may limit, suspend, or terminate access for misuse.

7) Plans, credits, and payments

Mbegu may offer free usage and paid plans.

Free usage

Free access may have limits (for example a daily scan limit). Limits may change over time and may be enforced automatically.

Paid plans and credits

Paid plans may provide a monthly credit allowance (e.g., “credits”). Credits:

• Have no cash value
• Are not transferable
• May expire or reset at the end of the billing cycle as displayed during purchase
• Are consumed when you successfully perform actions that require credits (e.g., scans)

Payments

Payments are processed by third-party payment providers. You authorize Mbegu and our payment providers to charge your selected payment method for purchases you confirm.

We store transaction references and status for verification and support, but we do not store full payment credentials.

Renewals and cancellation

If a plan is presented as recurring at checkout, it may renew automatically until canceled. If a plan is presented as one-time, you must repurchase to continue paid benefits after expiry.

Refunds

Except where required by law, purchases are non-refundable. If you believe you were billed in error, contact mbeguoffice@gmail.com.

8) Supplier information and third-party services

Supplier lists, maps, and locations may be provided by third-party services and may change without notice.

Mbegu does not guarantee supplier availability, pricing, licensing status, product quality, or service outcomes. You are responsible for verifying suppliers before purchasing.

9) Certificates and sharing links

If Mbegu provides certificate export or share links:

• Share links may be accessible to anyone with the link.
• You are responsible for who you share links with.
• Mbegu is not responsible for unauthorized sharing caused by you or third parties having access to your link.

10) Intellectual property

The Service, including design, text, code, and trademarks, is owned by Mbegu or its licensors and is protected by applicable laws.

You may not copy, modify, sell, or distribute the Service without our written permission.

11) Privacy

Our Privacy Policy explains how we process personal data. By using Mbegu, you agree that we may process personal data as described in the Privacy Policy.

12) Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

To the maximum extent permitted by law:

• Mbegu disclaims all warranties, including fitness for a particular purpose, accuracy, and non-infringement.
• Mbegu does not warrant that the Service will be uninterrupted, error-free, or that outputs will be correct.

13) Limitation of liability

To the maximum extent permitted by law, Mbegu will not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, business, data, goodwill, or farming outcomes

Mbegu’s total liability for any claim relating to the Service will not exceed the amount you paid to Mbegu in the 3 months before the event giving rise to the claim (or, if you have not paid anything, a reasonable nominal amount), unless law requires otherwise.

14) Indemnity

You agree to indemnify and hold Mbegu harmless from claims arising out of:

• Your misuse of the Service
• Your uploaded content
• Your violation of these Terms or applicable law

15) Termination

You may stop using Mbegu at any time.

We may suspend or terminate your access if you violate these Terms, if we are required to by law, or if your use creates risk or harm.

Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and dispute terms) will survive.

16) Changes to these Terms

We may update these Terms from time to time. If changes are material, we will provide notice through the Service or other reasonable means.

Your continued use after changes become effective means you accept the updated Terms.

17) Governing law and disputes

These Terms are governed by the laws of Zambia.

Unless prohibited by law, disputes will be resolved in the courts of competent jurisdiction in Zambia.
